Terms of Service

Please read these Terms of Service ("Terms") carefully before using the BeeStudio mobile application ("App") operated by BeeStudio ("we", "us", "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using BeeStudio, you confirm that you are at least 16 years old and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the App.

2. The Service

BeeStudio is a fitness tracking application that allows you to:

• Log workouts, exercises, sets, and training sessions
• Follow and create structured training plans
• Sync health and fitness data from Apple HealthKit (iOS) and Google Health Connect (Android)
• Connect with trainers for coaching and plan assignments
• Connect with friends and share your fitness journey
• View analytics, personal records, and progress over time

The App is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

3. Your Account

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Impersonate other users or misrepresent your identity or qualifications
• Attempt to access other users' data or accounts without authorization
• Abuse, harass, threaten, or send unwanted content to other users
• Upload malicious content, spam, or attempt to interfere with the App's operation
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated tools (bots, scrapers) to access or collect data from the App
• Share your account credentials with others or allow others to use your account

5. Your Content

You retain ownership of all data and content you create within the App, including workouts, exercises, training plans, notes, and profile information.

By sharing content with other users (trainers, friends, or publicly), you grant those users a limited, non-exclusive right to view that content within BeeStudio as intended by the sharing feature. This permission is revoked when you remove the connection or delete the content.

You grant us a limited license to store, process, and display your content solely for the purpose of providing the App's functionality. We do not claim ownership of your content.

6. Community Exercises

You may contribute exercises to the community library. By submitting an exercise for community approval, you:

• Confirm that the content is original or that you have the right to share it
• Grant BeeStudio a non-exclusive, royalty-free license to display the exercise to all users
• Understand that submissions are reviewed and may be approved, rejected, or removed at our discretion

7. Coaching

BeeStudio enables connections between athletes and trainers. By using the coaching features, you acknowledge that:

• BeeStudio does not verify, certify, license, or endorse any trainer on the platform.
• Any training relationship, plan, or advice is solely between you and the trainer.
• BeeStudio is not responsible for the quality, safety, or suitability of any training advice, plan, or program provided through the App.
• You should consult a qualified healthcare professional before starting any new exercise program, especially if you have medical conditions or injuries.

8. Health Data Disclaimer

BeeStudio is not a medical device. Health data displayed in the App (heart rate, calories, HRV, GPS routes, etc.) is imported from third-party platforms (Apple HealthKit, Google Health Connect) and from wearable devices. This data is provided for informational and fitness tracking purposes only.

• We do not guarantee the accuracy, completeness, or reliability of health data.
• Do not use health data from BeeStudio to make medical decisions.
• If you experience health concerns during exercise, stop immediately and seek medical attention.

9. Intellectual Property

The BeeStudio app, including its design, code, branding, logo, icons, and documentation, is owned by BeeStudio and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our prior written consent.

10. Account Termination

By You

You can delete your account at any time from within the App (Profile, scroll to bottom). When you delete your account, your data will be removed from our servers as described in our Privacy Policy.

If a trainer deletes their account, all coaching relationships are automatically dissolved. The client's own data (workouts, analytics, personal records) remains fully accessible. Coaching plans created by the trainer are removed, as the trainer owns that content. If a client deletes their account, the trainer's account, plans, and other clients are unaffected.

By Us

We may suspend or terminate your account at any time if you:

• Violate these Terms of Service
• Engage in abusive or harmful behavior towards other users
• Use the App in a way that could damage, disable, or impair the service

We will make reasonable efforts to notify you before or at the time of termination, except where we believe immediate action is necessary.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• BeeStudio is provided without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.
• We are not liable for any injuries, physical harm, health issues, losses, or damages arising from your use of the App, reliance on its data, or any training advice received through the platform.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.
• Our total liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless BeeStudio, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Third-Party Services

The App integrates with third-party services including Apple HealthKit, Google Health Connect, Mapbox, and Sentry. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Portugal.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the App and delete your account.
